What a family lawyer handles

Family lawyers guide people through separation, divorce, parenting arrangements, support, and the division of property. Some of the work is contentious and ends up in court. A lot of it doesn't. Many Ontario family lawyers now lead with negotiation, mediation, and collaborative practice, which tends to be faster and less costly than litigation when both sides are willing.

Do you have to go to court?

Often, no. Separation agreements, cohabitation agreements, and marriage contracts are all drafted and settled outside court. Court becomes necessary when the parties can't agree or when there's urgency, like a safety concern or a parenting dispute that can't wait. A good family lawyer will tell you honestly which path fits your situation.

Choosing the right fit

Family matters are personal, so fit counts as much as credentials. Ask whether the lawyer favours settlement or litigation, how they bill, and whether they're trained in collaborative practice or mediation if that's the route you want. Some firms also take Legal Aid certificates for child protection and other qualifying matters.
