Estate and trust litigation

Bobila Walker Law challenges and defends wills on grounds that include a testator's incapacity, undue influence, fraud or forgery, and faulty execution, and it brings or answers dependant support claims under Part V of the Succession Law Reform Act. It also handles passing of accounts proceedings and applications to remove an executor, trustee or guardian for misconduct or incompetence. On passing of accounts, Daniel Walker acts for both beneficiaries and fiduciaries, tracing assets, testing spending and pursuing claims of misappropriation or careless administration.

Probate, estate administration and trusts

The firm prepares Certificate of Appointment of Estate Trustee applications, with or without a will, gets clearance certificates from the Canada Revenue Agency, and applies to have non-resident estate trustees appointed in Ontario, including trustees in Germany. It can help move a trust to another jurisdiction or country. Its trust work runs from alter-ego and Henson trusts to insurance, pet and cottage trusts, and it brings court applications to vary a trust's terms when life changes.

Guardianship, powers of attorney and elder abuse

Daniel Walker acts on contested guardianship applications under the Substitute Decisions Act, from urgent interim orders protecting a vulnerable adult's property to preparation for a full hearing. The firm has represented seniors who experienced elder abuse, and families trying to stop abuse by a relative or fiduciary. Because guardianship and power of attorney disputes are about a person's care rather than recovering assets, they're generally billed hourly.

Family law and complex separations

Bobila Walker Law handles divorce, including international divorce, as well as property equalization, parenting, and child and spousal support, and it drafts and enforces marriage, prenuptial and cohabitation agreements. Daniel Walker's family files include high-value cases with international property, concealed assets or jurisdiction disputes between Canada and Europe, and the firm draws on specialists in forensic accounting, business valuation and economics. Hague Convention child abduction

The firm acts for parents on either side of Hague Convention cases and regularly appears in the Ontario Superior Court of Justice on return applications, carrying them through cross-examination and final argument. In a ruling reported in October 2025, with Daniel Walker as counsel for the mother, the Superior Court found that Hong Kong court orders gave the mother custody rights under articles 3 and 5(a) of the Convention.

German-Canadian estates and inheritances

German and German-speaking clients with Canadian legal matters are a substantial part of the practice, and the firm also helps clients with German inheritances and pensions. Bobila Walker Law has close ties with firms in Germany, works alongside German counsel, gets the documents each country requires and has them translated, and keeps the Ontario and German administrations moving together. Commercial work includes construction liens, shareholder and partnership disputes, real estate and title insurance claims, and defamation.
