About Kelly Gill

Kelly Gill is a partner in Gowling WLG's Toronto office who litigates intellectual property disputes, with trademarks and unfair competition at the heart of the work. Gill's appeared in courts at every level across Canada, taking on both trial and appellate work as lead counsel in the Supreme Court of Canada, the Federal Court of Appeal, the Federal Court and the Ontario Court of Appeal.

Called to the Ontario bar in 1993, Gill became a partner at the firm in 1999 and has since led two of its practice groups, Trademarks, Brands & Designs and IP Litigation & Strategy. Some of the country's defining copyright and trademark rulings carry the partner's name as counsel: the Law Society of Upper Canada's fair dealing dispute with CCH Canadian, argued from trial through to the Supreme Court in 2004, and the Masterpiece v. Alavida Lifestyles appeal in 2011.

Writing is the other half of Gill's reputation. Gill is a co-author of Fox on Canadian Law of Trade-marks and Unfair Competition, a text first released in 2002 that's kept current as a looseleaf service, and courts including the Supreme Court of Canada have relied on it. There's also Trial by Survey: Survey Evidence and the Law, along with book chapters and IP articles. Teaching is part of the picture too. Gill has taught trademark law as an adjunct professor at Osgoode Hall Law School, has served on IP Osgoode's advisory board, and lectures at Western and the University of Toronto.

On the editorial side, Gill is a Canadian contributing editor of the European Intellectual Property Review and has served on the boards of the Canadian Intellectual Property Review and Patent World in London. Clients can work with Gill in English or French.
