About Emily
Emily McCarthy practices administrative law, access to information and privacy law, federal litigation, and national security law. In 2020 she was appointed Associate Lead Assessor for the CAF-DND Sexual Misconduct Class Action Settlement, and from 2016 to 2020 she served as lead counsel to the Honourable Michel Bastarache in his role as Independent Assessor for the Merlo Davidson Class Action Settlement. From 2011 to 2015 she worked at the Office of the Information Commissioner of Canada, rising to Assistant Information Commissioner after serving as General Counsel, and she led numerous investigations into complaints under the federal Access to Information Act. Earlier in her career she was Acting Deputy Chief Administrator (Judicial Services) for the Courts Administration Service and counsel, then senior counsel, to the Chief Justice of the Federal Court from 2003 to 2010. She articled with the Honourable Allan Lutfy at the Federal Court from 1998 to 1999 and was called to the Ontario bar in 2000. McCarthy volunteers with the Refugee Sponsorship Support Program, providing pro bono advice on refugee sponsorship and settlement.
