About EKM Law Professional Corporation

EKM Law Professional Corporation is a small Ottawa firm made up of two lawyers, Emily McCarthy and Ash Deathe, who focus on workplace investigations and mediation. The firm works on complaints touching human rights, harassment, national security, and access to information and privacy law, and it takes on clients across Ontario and the rest of Canada. Rather than running a walk-in office, EKM Law delivers its services by Zoom unless a client asks for something else, and it can work with capped fees or hourly billing depending on the file.

Both lawyers came to investigation and mediation work through federal class action settlements. McCarthy served as Lead Counsel to the Independent Assessor for the Merlo Davidson class action settlement from 2016 to 2020, then was appointed Associate Lead Assessor for the CAF and DND sexual misconduct class action settlement in 2020, after several years at the Office of the Information Commissioner of Canada. Deathe was counsel to the Independent Assessor on the same Merlo Davidson settlement from 2018 to 2020 and has taught legal writing and dispute resolution at the University of Ottawa's law school. EKM Law also administers a claims process for CAF pre-enrolment medical sexual misconduct matters, handled by a separate claims administrator.
