About Mark Giavedoni

Mark Giavedoni is a partner in Gowling WLG's Hamilton office and an LSO Certified Specialist in Real Estate Law. Municipalities, universities, school boards and utilities bring complex real estate questions to Giavedoni, and so do other lawyers. The work covers a property's whole life: buying and selling it, financing and leasing it, structuring and developing a project on it, and managing the facilities once they're running.

Within the firm, Giavedoni leads both the Real Estate Practice Group in Canada and the Real Estate Industry & Sector Group, and also belongs to the national Construction & Infrastructure, Energy and Expropriation groups. Speaking to Law Times about the national role, Giavedoni described it as coordinating the firm's real estate people so they can respond to clients at a local and national scale.

Giavedoni was called to the Ontario bar in 2005. After spending 2004 to 2013 at Evans, Philp LLP, Giavedoni moved to ESB Lawyers LLP, a Hamilton firm, in 2013. ESB merged with Gowling WLG in January 2019.

Giavedoni has been involved with the Hamilton Law Association since 2006, through stints as trustee, secretary-treasurer and vice president before the 2019 to 2020 presidency. Today the partner is 1st Vice-Chair of the Federation of Ontario Law Associations and chairs its Real Estate Committee, and FOLA presented Giavedoni with its President's Award in 2021. Among the achievements Giavedoni lists right next to that award? Surviving two teenagers.

Real Estate Law

Commercial real estate transactions and financing

Purchases and sales, commercial leases, financings and secured lending, and title repairs. Past files include a leasehold mortgage and security over leasehold interests on a brownfield site, a family office's sale of four apartment building sites to a REIT, and the sale of a hotel near Niagara Falls.

Condominiums and development projects

Condominium structures, land use planning and assembly, and construction contracts. Giavedoni set up a leasehold condominium corporation for a public hospital and university, and was project counsel on a six-phase, four-tower mixed-use condominium project in Waterloo Region.

Expropriation and education sector work

Expropriations for LRT projects and educational establishments, including school sites taken by school boards. The work also includes drafting education development charge bylaws and acting on related appeals.

University and student residence projects

Project counsel to universities on student residence projects, with advice on structuring post-secondary residential projects that use alternative procurement and financing.
