About Mark E. Day

Mark E. Day is a Waterloo litigator at Duncan, Linton whose practice centres on construction law, set within a wider commercial and civil litigation practice. Mark's courtroom work already spans the Superior Court of Justice, the Divisional Court and the Court of Appeal for Ontario. ADR is part of the toolkit too, for disputes that get resolved outside a courtroom.

Law school was always the plan, but Mark took a break from school after a philosophy degree at Queen's. That detour meant compliance work at one of Canada's Big Five banks, followed by a stint as a Provincial Offences Officer enforcing public safety rules. Mark then studied law at the University of Ottawa, articled with an international firm and, once called to the bar in 2024, came to Duncan, Linton as an associate.

Negotiation and advocacy are where Mark stood out as a student. Mark and a uOttawa classmate first won the Dentons Annual Negotiation Competition, then took first place at the Canadian National Negotiation Competition at McGill's law faculty in February 2023 after three rounds against law students from across the country. That result sent them to Europe to represent the school and Canada at the International Negotiation Competition, where Mark finished third. Mark had also mooted on uOttawa's 2022 Willem C. Vis International Commercial Arbitration team, which reached the Top 64.

Mark grew up in Mississauga. Outside work, life revolves around a growing family and cooking, plus a long-suffering attachment to the Toronto Maple Leafs.
