About Fiona

Fiona Martyn is a partner in Samfiru Tumarkin LLP's labour and employment group, working out of the firm's Toronto and Ottawa offices. She represents both employers and employees on wrongful and constructive dismissal, temporary layoffs, severance agreements, employment contracts, and workplace harassment and human rights complaints. She has appeared before the Superior Court of Justice, Small Claims Court, the Human Rights Tribunal of Ontario, the Ontario Labour Relations Board, the Grievance Settlement Board, and the Social Security Tribunal of Canada. Before joining Samfiru Tumarkin, she articled and practised at a boutique Toronto labour and employment firm, giving her a balanced perspective from advising both sides of the employment relationship. In one notable case, she helped a senior executive secure more than $300,000 after arguing a return from maternity leave led to a constructive dismissal. In another, she and a colleague obtained 16 months of severance for a client whose pandemic-era layoff was found to amount to constructive dismissal at common law.
