Duncan Embury is a Partner and Head of Litigation at Neinstein, representing patients hurt by medical harm with particular attention to birth injury and brain injury matters nationwide. He also takes on complex, multiparty civil litigation involving institutional negligence, product liability, and municipal liability, and is often asked by other lawyers to run trials on their behalf. He recently served as counsel in KB v Guhle (2025 ABKB), a significant medical malpractice case where Alberta's top trial court held a physician responsible for catastrophic injuries suffered by an infant patient after failing to meet the required standard of care. His other notable wins include Doobay v Fu, Hasan v Trillium Health, and Hemmings v Peng, along with an appeal win in Farej v Fellows. Duncan earned his LLB from the University of Windsor in 1994, was called to the Ontario bar in 1996 and the Alberta bar in 2018, and the Law Society has also certified him as a civil litigation specialist.
