What does a real estate lawyer in Greater Victoria do?

A real estate lawyer in Greater Victoria handles the legal side of buying, selling, or refinancing property, from reviewing the purchase contract to registering the transfer on closing. British Columbia offers a second route: a notary public can also carry out a conveyance. BC notaries are a distinct regulated profession commissioned by the Supreme Court of British Columbia, and they handle non-contentious transfers, mortgages, and covenants (Society of Notaries Public of BC). A lawyer's scope is broader, so a dispute, an estate, or a title problem usually goes to a lawyer. A contested real estate claim is heard in the Supreme Court of British Columbia at the Victoria Law Courts on Burdett Avenue (Supreme Court of BC, 850 Burdett Avenue).

How does registering a Greater Victoria property work?

Ownership becomes official only when the transfer registers in the provincial land title register, operated by the Land Title and Survey Authority of British Columbia (LTSA). Your lawyer or notary files electronically, and title passes when the registration is accepted, not when you get the keys. Before that, the firm searches title for anything registered against the property: mortgages, easements, rights of way, or covenants that limit what you can build. Around newer subdivisions in Langford and Central Saanich, building-scheme covenants come up often, and waterfront lots near Sidney can carry access issues a listing won't mention.

What taxes and exemptions apply to a Victoria home purchase?

Buyers in British Columbia pay Property Transfer Tax when the transfer registers, calculated on the property's fair market value (Property Transfer Tax). Rates are tiered and change over time, so confirm the current figure before you budget. Two exemptions help many buyers: the first-time home buyers' program (first-time home buyers) and the newly built home exemption (newly built home), each with its own price limits. Greater Victoria also sits inside two extra tax zones. The Capital Regional District is a specified area for the additional property transfer tax on foreign buyers (additional tax areas), and its municipalities are taxable areas for the speculation and vacancy tax (taxable areas). If you're buying from outside Canada or leaving a home empty, ask about both before you sign.

How do you choose a real estate firm in Greater Victoria?

Start by matching the firm to your deal. A condo purchase in Victoria or a first home in Langford is routine work, while a rural acreage in Saanich, a downsize in Oak Bay, or a corporate purchase needs someone who handles those regularly. Ask who'll do the conveyancing, whether a lawyer or a notary, how your deposit and closing funds are held in trust, and what you'll pay in fees and disbursements, in writing. It's worth a quick call before you make an offer.
