About Eric Dolden

Insurance law has been Eric Dolden's focus for 46 years. Eric's courtroom work spans the whole range of claims that liability insurers defend, and alongside it Eric gives coverage advice and drafts and revises E & O policy wordings for underwriters. Eric is one of the founding partners of Dolden Wallace Folick and is based in Vancouver.

Before the firm existed, Eric practised at Freeman and Co. in Vancouver. In 1994 Eric left to open an insurance defence firm with Steve Wallace and Lorne Folick. Since then, coverage work, including roles as monitoring and national counsel on specialized insurance programs, has made Eric the insurer's counsel in coverage cases across Canada. They include a Supreme Court of Canada decision on an insurer's duty to defend a sexual abuse claim, and another where the Court looked at whether an All Risk property policy counts as Fire Insurance under the Insurance Act.

One trial lasted 104 days, arose from a catastrophic brain injury and involved a large body of medical-legal expert evidence and questions about the standard of care. Eric has also taken on the novel question of whether a casino owes a duty of care to patrons who've excluded themselves, defended a law firm accused of a fiduciary breach because of a conflict of interest, and defended several class actions that followed the XL Foods recall (Harrison v. XL Foods Inc., 2014 ABQB 720).

Eric has been writing about insurance law since at least 1989, and the list now covers subrogation, construction risks, D & O and employment practices coverage.
