Elliott Simcoe is a principal at Smart & Biggar in Ottawa who helps companies secure and make use of the rights in their technology, especially inventions in electrical and computer fields, software and AI. Simcoe drafts and prosecutes Canadian patent applications and oversees filings in other countries, and the work also reaches into patent litigation, Canadian trademarks, copyright and domain names.

Trained as an electrical engineer at the University of Waterloo before law school at Queen's, Simcoe was called to the Ontario bar in 1996. Registration as a trademark agent came that same year and as a patent agent in 1999, and Simcoe's also registered to practise before the United States Patent and Trademark Office. In 2020 Simcoe was the firm's national practice group leader for patents and technology, and was urging entrepreneurs to learn how to leverage their IP.

The client list runs from blue chip companies to mid-size businesses in fast-growing industries, and plenty of them are based outside Canada, many in the US. Most of the work comes from Canada and the United States, though associate firms in the US and Europe often bring their own clients to Simcoe for protection here. Whatever the file, Simcoe makes a point of running each portfolio with precision and no surprises, from prosecution right through to enforcement.

Speaking invitations have taken Simcoe from Ottawa's International Game Conference, where the 2015 topic was protecting IP in video games, to a 2008 domain name panel in Berlin and a 2019 panel on robot lawyers in Taipei.
