About David M. Lobl

David M. Lobl is a litigator for estate, trust and mental capacity disputes. David is a Toronto partner at Gowling WLG and co-leads the firm's National Private Client Services Group. Clients range from trust companies and government agencies to estate trustees, guardians and attorneys for property, and other individuals caught up in these fights.

Since being called to the Ontario bar in 2006, David has built a courtroom practice that runs from trial through appeal. David litigates challenges to a will's validity, undue influence allegations and disputes over what a will means. Other files involve estate and dependant support claims, contested passings of accounts, and fights with or between trustees, including breach of trust actions and applications to vary a trust.

Solicitor negligence defence for LawPRO

As LawPRO's preferred counsel on estate and trust questions, David defends negligence claims brought against solicitors. That work can include dealing with the Canada Revenue Agency on voluntary disclosures under the Income Tax Act and fixing wills and trusts that were drafted badly.

Capacity disputes and estate mediation

  • Chambers Estate v. Chambers, 2013 ONCA 511

    David acted for the Bank of Nova Scotia Trust Company, which the judgments under appeal had named sole succeeding estate trustee when the previous estate trustee of both wills was removed. The Court of Appeal dismissed Michael Chambers' appeals.

  • Burton v. Assaf, 2013 ONCA 658

    With Archie Rabinowitz and Rebecca Studin, David was counsel for the respondent Bernard Burton. The court dismissed an appeal from a judgment that had thrown out the appellants' action and declared William Assaf a vexatious litigant.
