About Brian Rhodes

Brian Rhodes is a partner in Dolden Wallace Folick's Vancouver office, and the whole of Brian's practice is insurance law. Most of it centres on three fields: construction, professional liability and product liability. Clients have included architects, engineers and lawyers facing negligence claims, developers, municipalities and contractors caught up in building disputes, and insurers looking into suspected fraud.

Brian was called to the bar in British Columbia in 1991, then added calls in the Northwest Territories in 2010 and in Yukon in 2020. Brian has acted as counsel at every level of court in BC and Alberta, and courtroom work has also taken Brian to Ontario's Superior Court and to Yukon's Supreme Court.

Brian is a Fellow of the Construction Lawyers Society of America. Fellowship there comes by invitation only, and it's capped at 1,200 practising lawyers around the world. From 2013 to 2024 Brian also taught at the UBC law school as an adjunct professor.

When a professional faces a claim, Brian works hand in hand with that client to pin down exactly what services were provided and how well, then brings in outside specialists to help build the defence.

Professional negligence defence

Brian has represented many professionals, among them lawyers, architects and engineers from a range of disciplines, against allegations that they were negligent in their professional work.

Subrogation and fraud investigations for insurers

For insurers, Brian has brought subrogated claims against designers, installers and component manufacturers after losses at heavy-industry sites, where the damage to property was severe and business was interrupted. Brian has also investigated suspected fraud for insurers, working with commercial crime investigators and bankruptcy trustees, so coverage decisions can be made on full information.

Professional discipline

Brian represents professionals in discipline proceedings before their governing bodies, learning the regulatory framework that applies and testing every allegation of misconduct with care.

Directors' and officers' liability

Brian has advised directors on due diligence obligations under securities, environmental and employment legislation, and has acted for corporations and directors in oppression claims and for directors accused of misusing a corporate opportunity.

Amateur sport injury claims

Brian has acted for amateur sporting associations when plaintiffs claimed for bodily injuries suffered while playing or while on the association's premises, using mediation and summary trial to resolve those cases.
