Kim Spencer McPhee Barristers P.C. is a small Toronto litigation firm at 1200 Bay Street, at the corner of Bay and Bloor, that concentrates on complex, high value class actions, acting mainly for plaintiffs but also handling defence side securities work. Five lawyers practice at the firm. It was previously known as Kim Orr Barristers before taking its current name to reflect additional principals Michael Spencer and Megan McPhee. Its cases have covered securities, medical device and pharmaceutical product liability, insurance, shareholder disputes, and antitrust matters, argued before courts across Canada, the United States, and internationally, up to the Supreme Court of Canada.
Michael Spencer built a career in U.S. securities litigation before joining the Ontario bar in 2011: a law clerk in Los Angeles, then an associate at Cravath, Swaine and Moore from 1978, then the plaintiff side at Milberg from 1986, remaining of counsel there, including as counsel for plaintiffs in the Vivendi S.A. securities trial that produced a record-breaking jury verdict in 2010. Managing Principal Megan McPhee has more than twenty years of class action and complex commercial litigation experience, currently serves as Class Counsel on the Sun Life universal life insurance class action (a proposed $213.5 million settlement announced in June 2026), and co-edits the Kim Spencer McPhee Class Action Monitor, a Thomson Reuters reporter on Canadian class action law.
Wheelchair accessibleThe firm's office is Suite 1203 at 1200 Bay Street, a twelve storey office and retail building completed in 1966 at the northwest corner of Bay Street and Bloor Street. The Globe and Mail has described that corner as one of Canada's most upscale intersections and a magnet for high end retail. The corner sits at the edge of Yorkville, a neighbourhood known in the 1960s as a counterculture destination and now known as a shopping and professional district, with some of the older streetscapes a few blocks north still carrying traces of that earlier era.
