About Tony

Tony Serka is a Vancouver criminal defence lawyer known for a series of landmark cases, including two heard by the Supreme Court of Canada. In Hutt v The Queen, he successfully argued that courts had been misinterpreting the definition of soliciting for the purpose of prostitution under the Criminal Code. In R. v. Smith (1987), he helped strike down a mandatory minimum seven-year sentence for drug importation as a violation of the Charter's protection against cruel and unusual punishment. Serka was designated Queen's Counsel by the Attorney General of British Columbia in 2002, and has represented clients including Claire Wilson and Curtis Mason in high-profile murder trials. He was also the first lawyer to challenge Vancouver's 1982 anti-solicitation bylaw, a challenge that led to the bylaw's eventual repeal.
