Maple Anne Cameron and Daniel J. Fife acted for the respondent, who had run a bricklaying business in Kitchener, after the insurer appealed the punitive and mental distress damages awarded at trial over its failure to pay disability benefits. The court upheld the punitive damages award but allowed the appeal on mental distress damages. With success divided, each side was left to bear its own costs of the appeal.

The neighbourhood
Maple Cameron Law's office is at 68 Queen Street North in Kitchener. A downtown heritage site, the Waterloo County Jail and Governor's House, sits on the same street at number 73.
The jail went up in 1852, the year Berlin became the county seat, and the building is a symbol of the city's judicial independence. Local architect David W. Gingerich added the Governor's House in 1878; it was where the jailer lived, and it formed part of the complex for a century.
