What does an administrative lawyer in Durham Region do?

An administrative lawyer helps people and businesses deal with government agencies, regulators, and the tribunals that decide these disputes. In Durham Region that work often runs through the boards under Tribunals Ontario, including the Landlord and Tenant Board, the Human Rights Tribunal of Ontario, and the Licence Appeal Tribunal. When a decision has to be challenged in court instead, the case is heard at the Superior Court of Justice, which sits at the Durham Region Courthouse at 150 Bond Street East in Oshawa.

How do workplace injury claims and appeals work?

Workplace injury claims don't go to a regular court. They run through the Workplace Safety and Insurance Board, the provincial agency that decides benefits for workers hurt on the job. If you disagree with a WSIB decision, you first ask the board to review it internally, and the final step is an appeal to the Workplace Safety and Insurance Appeals Tribunal, an independent body separate from the WSIB.

For a worker at a Whitby plant or an Ajax warehouse, this replaces the right to sue an employer over the injury. A lawyer or a licensed paralegal can gather the medical evidence and meet the appeal deadlines, which are strict.

When can you ask a court to review a decision?

If a tribunal or a government body got it wrong, you may be able to bring an application for judicial review. In Ontario these go to the Divisional Court, a branch of the Superior Court of Justice and the main forum for reviewing government action. Judicial review isn't an ordinary appeal. The court asks whether the decision was fair and reasonable and whether the body had the power to make it, not whether you'd have preferred a different result.

Timing matters here. An application generally has to be started within 30 days of the decision, so a Pickering or Clarington resident who wants to challenge a ruling should act quickly. A lawyer can tell you early whether review is the right route or whether an internal appeal comes first.
