About Over 80 Law by Stephen Price & Associates

Over 80 Law by Stephen Price & Associates is a Toronto firm that defends only driving related charges: impaired operation, refusal or failure to comply with a breath or blood demand, dangerous driving, and Highway Traffic Act offences such as careless driving, stunt driving, and driving under suspension. Founder Stephen Price was called to the Ontario bar in 1976 and has spent decades on drinking and driving cases. Through the Law Society of Ontario's continuing legal education program, Price has also taught impaired driving law to lawyers and to judges. The firm's name comes from the Criminal Code threshold of 80 milligrams of alcohol per 100 millilitres of blood, the reading that defines the offence.

Two more lawyers round out the practice. A second lawyer was called to the Ontario bar in 2011 after a Civil and Common Law degree from Osgoode Hall Law School, works in Mandarin, English and French, and has also built businesses in cannabis production, personal protective equipment, and hydrogen energy. A third lawyer, called to the bar in 2025, holds an LLM from Osgoode Hall Law School and an earlier LLM from Leiden University in the Netherlands, previously practiced as a partner at a firm in Shanghai, and is also licensed to practice in China. The office is at 120 Eglinton Avenue East in Toronto, and the firm represents clients across Ontario with 24 hour phone access and both in person and virtual meetings.

The neighbourhood

The firm's office is in an eleven storey Modernist building at 120 Eglinton Avenue East, just west of Redpath Avenue in Toronto's Yonge and Eglinton area. The building dates to the boom that followed the 1954 opening of the TTC's first subway line, when the Yonge line ended at Eglinton station. A developer has since filed plans to demolish it and build a 70 storey, roughly 232 metre tower on the site, part of a cluster of tall proposals near the Eglinton Crosstown LRT. For now, the firm's suite sits in one of the corridor's original postwar office buildings, with underground parking reached from Eglinton Avenue East and Mount Pleasant Road.

Frequently asked questions

I was charged with driving with a blood alcohol level over 80 milligrams, can Over 80 Law help?
Yes. The firm focuses on impaired driving and over 80 charges and reviews the breath or blood testing, the arrest, and the police investigation for problems that could affect the case.
What's the difference between a dangerous driving charge and an impaired driving charge?
Dangerous driving looks at the manner of driving itself rather than the driver's condition. The Crown has to prove the driving created a significant risk given the circumstances, and Over 80 Law handles both types of charges.
I refused to give a breath sample. Does that mean I'll automatically be convicted?
No. Refusal or failure to comply with a lawful demand is a separate criminal charge under the Criminal Code, and Over 80 Law looks at whether the demand itself was lawful and whether the accused understood it before deciding on a defence.
I got a stunt driving or racing charge under the Highway Traffic Act, does the firm handle that too?
Yes. Over 80 Law defends Highway Traffic Act charges including stunt driving, racing, careless driving, and driving under suspension, alongside its Criminal Code driving work.
Does Over 80 Law only take clients in Toronto?
No. The firm represents clients across Ontario, including remote areas, with both in person and virtual meetings and 24 hour phone access.
Is there a language other than English available at the firm?
Yes. Lawyers at the firm work in Mandarin, French, and Dutch in addition to English.
